Terms of Service(TOS) Coslinks Corporation ("CLC") agrees to furnish services to the subscriber, subject to the following TOS (Terms of Service). Use of CLC Service constitutes acceptance and agreement to CLC TOS (Terms of Service). 1. Disclosure to Law Enforcement: The TOS specifically prohibits the use of our service for illegal activities. Therefore, subscriber agrees that CLC may disclose any and all subscriber information including account history, account use, etc, to any law enforcement agent who makes a written request without further consent or notification to the subscriber. In addition CLC shall have the right to terminate all services set forth in this Agreement. 2. Service Rates: Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to subscriber. Subscriber is aware that CLC may change the specified rates and charges from time to time. The promotional offer is contingent upon CLC achieving and maintaining its cost of service goals including but not limited to rates charged to CLC by its suppliers. 3. In no event shall the company be liable for any special or consequential damages, loss or injury. 7. Support Boundaries: CLC, Provides 24 x 7 technical support to our subscribers (except for few holidays and short company meetings when we close our center.) by using our online support system. We limit our technical support to our area of expertise. The following is our guidelines when providing support: CLC provides support related to your Web-Hosting-Solution account. CLC does not offer tech support for application specific issues such as cgi programming, html or any other such issue. CLC does not provide technical support for your customers. We encourage you to check there first. 8. Email: CLC has a STRONG anti-spam policy and applies it. Spammers are NOT welcomed. If a customer is found to be in violation of our SPAM policy, CLC may, at its sole discretion, restrict, suspend or terminate customer's account. Further, CLC reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. CLC will notify law enforcement officials if the violation is believed to be a criminal offense. The customer acknowledges that he is responsible for any and all SPAM related actions which come from their account. Sending unsolicited email messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited even if the lists are said to be opt-in.Customer will not use another site's mail server to relay mail without the express permission of the site. It is strictly forbidden to send out unsolicited email from any other network that advertises, promotes or in any way points to a location inside CLC network 9. Bandwidth and Disk Usage: They may not be used for general storage of any type. All content stored on an unlimited account must be directly used on the Internet by the website associated with that account. These accounts may not be used as a download distribution point for your software or media. They are to be used for standard web practices only. This means that all content stored on an unlimited account must be used for "acceptable" website use. "Unacceptable" usage is anything that a shared server would not be able to provide under standard circumstances. If all diskspace used is for acceptable websites, and all bandwidth used is for acceptable activity, then when we run out of diskspace and/or bandwidth, we simpy add more resources. However, if any domain hosted under your account requires resources that are not able to be provided by a shared server, then in such circumstances we may require you to rent a dedicated server for that domain. 10. Indemnification: CLC wishes to emphasize that in agreeing to the CLC Terms of Service (TOS), customer indemnifies CLC for any violation of the Terms of Service (TOS) that results in loss to CLC or the bringing of any claim against CLC by any third-party. This means that if CLC is sued because of a customer's or a customer of a customer's activity, the customer will pay any damages awarded against CLC, plus costs and attorney's fees. 14. Miscellaneous Provisions: You must provide us with, and keep current, good contact information of you. Email, fax, and telephone contacts are used, in that order of preference. a. A waiver by the company of any breach of any provision of this Agreement by subscriber shall not operate as or be construed as a continuing or subsequent waiver thereof or as a waiver of any breach of any other provisions thereof. b. Subscriber shall not transfer or assign this Agreement at anytime without the prior written consent of the CLC. CLC may assign Agreement at anytime without consent from or notice to subscriber. CLC reserves right to cancel customers right under this agreement at anytime without further obligation. c. CLC takes no responsibility for any material input by others and not posted to the CLC Network by CLC. CLC is not responsible for the content of any other websites linked to the CLC Network, links are provided as Internet navigation tools only. CLC disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy. d. It is absolutely forbidden to host pornographic content or IRC servers, Pirated software, Hacker programs or archives, warez sites, or MP3 Sites on virtual accounts. Any subscriber found hosting this material would be subject to immediate cancellation without refund. |
